Blasphemy law in Pakistan

Petition for acquittal filed on behalf of a Christian falsely accused of blasphemy.

News is that a Pakistani Christian namely Adnan Prince has moved the district and sessions court seeking acquitted from blasphemy charges. Adnan has been behind the bars on charges of blasphemy as an FIR containing Sections 295-A, 295-B and 295-C had been lodged against him. Consequently, Adnan was booked by the police in November 2013 and has been imprisoned since then.

It has been two years that Adnan has been fading away behind the bars and that too, without any solid grounds or substantial evidence. In this regard, the defense counsel of Adnan Advocate Asad Jamal has claimed that the prosecution has been delaying the proceedings deliberately. He said that thus far no significant evidence has been found against Adnan that he had actually committed blasphemy; thus proving that the charges were baseless. He went on to reveal that his client is in a miserable condition

Moreover, Advocate Asad Jamal argued that this case is absolutely groundless; he is certain that Adnan Prince can not be convicted. Adnan had been hooked after he allegedly passed spiteful remarks, about a leader of an Islamic outfit. He said that Adnan had not snubbed anyone’s religious feelings. Moreover, the complainant himself, has filed a petition seeking omission of the 295-A from the FIR.

Advocate Asad continued as he clarified that Section 295-B becomes applicable in cases that involved desecration of the Quran; and in this particular case no such act has been committed. Section 295-C, is applied in cases in which Prophet (PBUH) is disrespected; no such thing had been committed by Adnan Masih, which makes this charge void also.

“Even a report of the Punjab Forensic Science Agency had declared the evidence against the accused as inconclusive,” so much so that that on it’s base the court can not acknowledge it as convicting, thus Adnan Prince can not be held convicted and punished. Advocate Asad Jamal urged the court to acquit Adnan as his remarks about the Islamic outfit’s leader had been misinterpreted as blasphemy.

According to Irfan Masih, brother of the blasphemy accused, this was a pre- planned ploy in order to tear down his uncle Mushtaq Masih’ business. He alleged that the complainant, Abid Mehmood had joined his uncle Mushtaq Masih’ shop with an intention to harm his prosperous business.

Abid Mehmood deliberately put a book from the Islamic outfit’s leader which was titled “Main Ne Bible Say Poocha Quran Kyun Jalaye.” Abid claims that Adnan started reading the book and wrote derogatory remarks on the book which makes him a blasphemer.

Subsequently, Abid lodged an FIR against Adnan and told the local Muslims that Adnan had committed blasphemy. This incident has completely destroyed Mushtaq Masih’s business as he had to flee in order to save his life.
