Christian Divorce Act 1869 section 10 has been defied in front of the Lahore High Court for being “odious and insolent” to women.
On Thursday, the first hearing of the case was in front of Justice Mansoor Ali Shah. Here he directed the petitioner to bring related credentials in front of the court at the next trail, whose date will be fixed by the registrar’s office.
Ameen Masih, the petitioner said he was going through a divorce and that an appeal for maintenance was waiting before a civil court.
He said the major cause behind the divorce was that he and his wife were not happy together. He said he also did not get along with his in-laws.
Though, he said, under Section 10 of the Christian Divorce Act 1869 he could only divorce his wife if he blames her of adultery. He said he could not make an allegation he did not believe to be true.
Saying that the Act exists since the colonial times, he applies to the court to pronounce Section 10 of the Act severely immoral and in contravention of the Constitution through implement of judicial review.
He said a number of countries, including the UK and the USA, permitted a Christian man to file for a divorce on grounds like awkward behavior which enabled divorce petitions to be covenanted in a swift manner. He added Section 10 of the Christian Divorce Act 1869 was a blockage in appropriate separation between spouses who decided to do so. He said divorces under the Act had been ruining the illustration of innocent women.
