TOBA TEK SINGH: Sajjad Masih acquitted of blasphemy charges.
The Additional Sessions Judge tehsil Gojra District Toba Tek Singh Chaudhry Jamil Ahmad has vindicated Sajjad Massih Gill who was accused of blasphemy. Sajjad Masih had earlier received a life sentence for allegedly sending blasphemous text messages. Consequently, an FIR bearing number 80/12 under section 295 C and B PPC and section 25D of telegraph was registered against him and thus was booked by the police.
In line with details, two cases of blasphemy were filed against Sajjad and his ex-fiancé Roma Ilyas. Predominantly, in a case bearing FIR no 820/11 Sajjad was convicted life imprisonment as trial of this case was under hearing in the court of Chaudhry Jamil Ahmed.
While the defence attorney of Sajjad Masih Mr. Javed Sahotra put forward an application u/s 265k cr pc in Chaudhry Jamil Ahmed’s court, beseeching that,”An accused cannot be triad two times in same offence.”
Javed Sahotra comprehensively contended over decisive points thus arguing that,” Trial in this case against Sajjad Masih will be double jeopardy and constitution of Pakistan does not allow double trial in same offence, section 403 of Cr pc is also hindrance in the way to start trial in same offence.”
After hearing the arguments of Javed Sahotra; the Additional Sessions Judge Chaudhry Jamil Ahmed substantiated the arguments of Sajjad’s defence counsel whilst discharged him of blasphemy charges. FIR bearing No 80/12 u/s 295b and c PPC and section 25D telegraph act has been now quashed against Sajjad Masih.
Following the decision in favour of Sajjad Masih, congregation of the SDA Church Pakpattan assembled for a thanksgiving service and offered prayers.
